Members of the Dispute Resolution Panel in the Benke matter
Dear brothers in Christ,
Our congregation, one of the original complainants in
the Benke matter, declares a public protest against, and rejection of the basis
upon which the Dispute Resolution Panel (DRP) reached its ruling in the
aforementioned case. We are in concurrence with the Rev. Dr. Wallace Schulz and
the Scriptural and Confessional judgment derived from the voluminous evidence he
provided. We find no error or falsehood in the evidence he presented, and we
thus believe his judgment in the matter is correct.
Furthermore, we believe that an injustice has been done
to Christ and His Church because the basis for the DRP ruling, a misuse and
misinterpretation of Resolution 3–07A from the 2001 synodical convention,
violates the Scriptural and Confessional principles to which we are pledged as a
member of the Synod. We believe that this ruling must be reviewed and vacated
based upon the clear evidence provided by Dr. Schulz from God's Word and the
Confessions of the Evangelical Lutheran Church.
We are, therefore, compelled to repudiate the Commission
on Constitutional Matters (CCM) ruling on which the DRP based its decision, and
we intend by memorials, that will be submitted to the 2004 convention of the
Synod, to ask that it be overruled. We must do so precisely because it violates
these Scriptural and Confessional truths.
The anti-Scriptural and non-Confessional basis upon
which the Dispute Resolution Panel has reached its decision sets the Synod on a
new theological and confessional course. We are, therefore, compelled by truth
to reject the basis for the DRP ruling.
Submitted in fear of the true and living God and with
reverence for His perfect Word.

Dr. Schulz' Suspension of Dr. Benke
Lifted by Dispute Resolution Panel (DRP)
The DRP hearing the Benke case has,
on April 10, 2003, overturned Dr. Wallace Schulz' suspension of Dr. Benke.
Their reasoning comes from a controversial interpretation of Resolution
3-07A of the 2001 Synodical Convention.
Dr. Schulz, through the use of Holy
Scripture and the Confessions, did a masterful job upholding his decision in
the case.
The case began with the filing of charges against Dr. Benke for his
participation at "A Prayer for America" at Yankee Stadium on September 23, 2001,
in which he prayed with members of Christian denominations with which our Synod
is not in fellowship and with members of non-Christian cults.
Our congregation filed charges against Dr.
Benke on March 10, 2002, following a
presentation by the board of Elders to the Voters Assembly.
Voters Condemn ILLL,
Request Revocation of Auxiliary Status
The Voters Assembly at its December 8, 2002, meeting adopted a
resolution on the International Lutheran Laymen's League (ILLL).
Two of the five resolves state:
That
Christ Lutheran Church condemns the ILLL for the firing of Dr. Wallace
Schulz for the performance of his duties and for their stipulations for his
continued employment, which conflict with his ordination vows.
That Christ Lutheran Church hereby
requests that the Synod in convention revoke the ILLL's auxiliary status.
St. Michael and All Angels Hymn Festival 2002

Voters Adopt Resolution and Theses on Worship
The Voters Assembly, at its September 8, 2002, meeting,
adopted, with no dissenting votes cast, a resolution on worship.
The three resolves state:
That Christ Lutheran Church adopts "Worship in Our
Congregation" as the correct understanding of worship.
That copies of "Worship in Our Congregation"
be made available for anyone who desires to read and study it.
That congregations in the Sioux Falls Circuit, the South
Dakota District and the Lutheran Church–Missouri Synod be encouraged to likewise
study and adopt these theses and put them into
practice so that peace and unity may again prevail in our midst, according to
God's mercy.
